Privacy Policy

This page contains a description of how the web site manages the processing of the personal data belonging to the browsers who use it. This information is provided pursuant to art. 13 of Lgs.D. no.196/2003 - Data Protection Act to the users of the Altaeco S.p.A. web services, which can be accessed telematically from the www.appiani.it web site.

The subjects who use the Altaeco S.p.a. Group’s web sites (www.bardelli.it – www.appiani.it – www.gabbianelli.it –www.ceramicavogue.com) for professional purposes are required to comply with the provisions in the Data Protection Act and, in particular, with those in art. 130 regarding unsolicited communications (use of automatic call systems, e-mail, telefax, MMS or SMS texts), and those imposed by art. 130.3-bis, which requires that all subjects wishing to telemarket products/services to companies and consumers must consult the telephone preference service (TPS).

With regard to the option of being contacted for marketing purposes via the use of the telephone number published on the www.appiani.it web site, users who do not wish to be contacted by telephone for such purposes must expressly opt out by registering their number with the TPS (in Italy: Registro delle Opposizioni [www.registrodelleopposizioni.it], governed by D.P.R. 7/9/2010 no. 178). Therefore the consent previously expressed on that regard (and according to which the telephone numbers published in telephone directories could not be used for marketing communication purposes) is no longer effective, unless the users had expressly consented to it (by having a telephone handset added next to their names in the telephone directories).

DATA CONTROLLER, DATA SUPERVISORS AND PRIVACY COMMUNICATIONS

The Data Controller is the company Altaeco S.p.A., registered office in 20010 Vittuone (MI), Via G. Pascoli n. 4/6. An updated list of data supervisors, appointed by the Data Controller pursuant to art. 29 of Lgs. D. 196/2003, is available in the registered office of the Data Controller. For every communication regarding article 7 and the following articles of Lgs.D. no. 196/2003 and s.a.i. the Data Controller has provided this e-mail address: info@altaeco.com.

TYPES OF PROCESSED DATA

Browsing data.
The information systems and the software procedures responsible for the functioning of this web site acquire, during their normal use, some personal data, the transmission of which is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified concerned parties but, because of its nature, it could be possible to identify the users through processing and association with data held by third parties. This category of data includes IP addresses or domain names of computers used by the users who connect to the site, the URI (Uniform Resource Identifier) notation addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in reply, the numeric code indicating the state of the reply given by the server (completed, error, etc.) and other parameters related to the user's IT environment and operating system.

This data is used for the sole purpose of obtaining anonymous statistical information regarding the use of the web site and to check that the site is operating correctly.

The data could be used to establish responsibility in the event of hypothetical IT crimes that damage the web site.

PROVISION OF DATA

The provision of data by customers/browsers is optional and is needed to supply the services offered by the portal. PURPOSES OF THE PROCESSING

The user’s personal data is provided to Altaeco S.p.A. by the user, by third parties or obtained from public registers. It is processed:
  • To comply with the law, rules and EU regulations. Providing personal data for these purposes is mandatory and the processing of this data, including disclosing it to the “categories of subjects” listed below, does not require the consent of the parties concerned.
  • For purposes that are tightly related to and instrumental in the management of relations with customers. Providing personal data for these purposes is not mandatory and the processing of this data, including disclosing it to the “categories of subjects” listed below, requires the consent of the parties concerned because it is needed to fulfil the obligations arising from the contract.
  • For purposes related to market surveys and commercial information. In this case it is not mandatory to provide the data, which can only be processed if the party concerned consents to it.

Data supplied spontaneously by the user.
Sending an e-mail freely, explicitly and deliberately to the address listed in this web page implies the sender’s e-mail address is acquired as a result. Other personal data can be collected by completing specific forms in the web site but a specific consent is required for it.

DATA PROCESSING METHODS

Data is processed using IT and electronic means by specially assigned in-house individuals. The data is stored in IT and electronic files, with full assurance of the implementation of the minimum security measures required by law. Any communications of marketing or promotional nature related to the activities and the services of the Data Controller will be delivered via automatic contact methods or using traditional channels (e.g. snail mail and/or calls with an operator) in compliance with art. 130 of Lgs. D. 196/2003.

DISCLOSURE AND DISSEMINATION

The collected personal data shall not be disclosed or disseminated. Disclosing the information to third parties that are not the Data Controller, the internal managers or managers external to the company and the people in charge of the processing identified and appointed in compliance with articles 29 and 30 of Lgs. D. no. 196/2003 and s.a.i., is allowed in the case of public bodies (for fulfilling legal obligations) and of companies of the Group that the Data controller belongs to for administrative-accounting purposes in compliance with art. 24 paragraph i-ter of Lgs.D. 196/2003 and, where necessary to perform the activities listed in paragraph sub a). It is allowed in the case of third parties and subjects such as speakers, legal, sector-related and marketing consultants, hotels, debt collection agencies, administration and contract consultancy agencies, third parties supplying technical and IT assistance and services involved in the lawful and fair pursuit of the described aims. Data can be disclosed to firms of auditors for the legally required control duties. In all cases data processing by third parties must be performed lawfully and in compliance with the laws currently in force.

Altaeco S.p.A. will also be able to disclose your personal data, in compliance with the purposes listed in the Privacy Information note, to other companies, such as:

  • companies that Altaeco S.p.A. uses to perform its activities (e.g. supplying its services and carrying out commercial transactions);
  • web portals or advertising agencies of third parties, in order to present projects and applications with product collections from Ceramica Bardelli, Appiani, Vogue, Gabbianelli, as well as to obtain help in assessing the effectiveness of the advertisements, in compliance with the laws currently in force.

In the cases listed above Altaeco S.p.A. will ask the above mentioned third parties to process the disclosed data in compliance with this Privacy Information note, but it declines all responsibility in regard to the policies and the practices of these web sites that can be accessed via links.   • external collaborators and consultants;
  • in the case of mergers, assignments or transfers of the company (or company branches) that involve the activities of this web site, including the personal data processed by this web site, to third parties involved in the above mentioned operations for the purposes needed to correctly complete those operations. RIGHTS OF THE PARTY CONCERNED

The party concerned may exercise his/her rights as provided for by articles 7, 8, 9 and 10 of Lgs. Decree no. 196. issued on 30 June 2003 by contacting the Data Controller. In particular, according to art. 7, the party concerned has the right to obtain confirmation of the existence or otherwise of personal data related to him/her, including data that has not yet been recorded and to obtain that data in a clearly understandable form. The party concerned has the right to obtain information regarding: a) the source of any personal data; b) the purposes and methods of processing; c) the logic applied in the event of electronic processing; d) identification details relating to the Data Controller, the data supervisors and the representative designated in compliance with article 5, paragraph 2; e) the subjects and categories of subjects to whom the personal data may be communicated or who may become acquainted with said data, in their capacity as data supervisors, persons in charge of data processing and appointed representatives in Italy. The party concerned has the right to obtain: a) that said data is updated, amended and, if in the interest of the party concerned, completed; b) that any data processed in violation of the law be cancelled, made anonymous or blocked, including any information that does not need to be held for the purposes for which it was collected or subsequently processed; c) receive confirmation that the operations in a) and b) have been made known, also as regards their content, to the parties to whom the data has been communicated or disclosed, except in cases where this is impossible or requires the use of means that are clearly disproportionate with the protected right.
